ADMINISTRATIVE HEARINGS

The Administrative Hearing process was established to give students an opportunity to have behavioral issues addressed in an expedited manner. Students are encouraged to consider the charges carefully. Decisions should be made freely and without pressure from members of the administration or judicial body. All cases in which suspension is a possibility are under the jurisdiction of the Dean of Student Services, his designee, and the Honor and Ethics Council.

The Administrative Hearing process resolves incidents in which:

  1. there is an alleged social violation of the Code of Conduct (non-academic)

PROCEDURES FOR ADMINISTRATIVE HEARINGS

Students accused of a violation which qualifies for an Administrative Hearing will be informed in writing of possible violations of the Code of Conduct. The notice of the hearing may be accompanied by an incident report alleging the student's violation of University policies or regulations. The student will also be given information regarding the Student Advisor Program.

During the Administrative Hearing, the accused student, as well as any witness(es), will have the opportunity to provide his/her account of the incident in question. All parties will also have an opportunity to ask and answer questions. The Administrative Process is a non-confrontational review of relevant information by the hearing officer. After a thorough review of the information, the hearing officer will make a decision.

Possible outcomes of Administrative Hearings include:

  1. a finding of "responsible" for the charge(s)
  2. a finding of "responsible" for one or more, but not all, charge(s)
  3. the assignment of additional and/or alternative charge(s)
  4. a finding of "not responsible" for the charge(s).

The student will be advised of the hearing officer's decision. If there is a finding of "responsible," sanctions will be assigned.

Students accepting responsibility in the Administrative Hearing will sign a waiver of their right to appear before the Honor and Ethics Council and Judicial Council. They will also acknowledge their understanding of the consequences of non-compliance regarding completion of sanctions.

Students may appeal Administrative Hearing outcomes to the Judicial Council. The Judicial Council will hear appeals of all Administrative Hearing cases that result in a recommendation of suspension or expulsion. All other cases will be reviewed on a case-by-case basis.


ADMINISTRATIVE HEARING

Uncontested Cases

In cases where the only possible charges are underage possession and/or consumption of alcohol and public display, the student will have the option of accepting responsibility and waiving his/her right to an Administrative Hearing. This is done by signing and returning the letter sent by the Judicial Administrator. Sanctions and deadlines will be clearly outlined in the letter. It is the student's responsibility to complete the sanctions by the due date.

Appropriate actions taken in instances of non-compliance. These actions may include increasing sanctions, assigning or increasing of fines, assigning an additional charge of Contempt, blocking the ability to register, withholding transcripts or graduation, probation, suspension, and contact with parents, guardians, and/or interested parties.
